Welcome to https://forlovingyou.com/, the website of For Loving You FZE-LLC. These Terms of Use govern your visit and use of the Platform and form a binding agreement between the Platform and yourself. The Terms of Use must be read in conjunction with the Privacy Policy . 

 

The following definitions and interpretation apply to the Terms of Use:

 

AED	means the Arab Emirates Dirham;
Business Day	means a day (except Saturday, Sunday or public holidays) when banks in the UAE are open for business;
Delivery Charges	means the delivery charges applicable to all Products sold by the Platform;
FLY	means For Loving You FZE-LLC, an entity incorporated under the laws of UAE;
Force Majeure Event	means an occurrence beyond the control of a party that prevents such party from fulfilling its obligations under these Terms of Use, provided that such party could not have reasonably foreseen such occurrence at the time of entering these Terms of Use, and which could not have been reasonably avoided or overcome, including but not limited to disruption of internet, hacking, malware or bugs;
GCC	means the Gulf Cooperation Council a regional, intergovernmental, political, and economic union comprising Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and the United Arab Emirates;
Guest	means a visitor or user of the Platform who is not a Registered User;
Platform	means the online website of FLY with the URL https://forlovingyou.com/, which is managed and handled in entirety by us;
Privacy Policy	means the Privacy Policy of the Platform available at www.forlovingyou.com ;
Products	means the products, including but not limited to women’s apparel, sold on the Platform by FLY;
Registered User	means a user who has successfully completed the registration process on the Platform;
Terms of Use	means this document that contains the terms and conditions that govern the use of the Platform;
Third-Party Sites	means third-party web pages linked on the Platform;
UAE	means United Arab Emirates;
Us/ Our/ We	refers to the Platform domiciled in the UAE and its affiliates, subsidiaries and related entities;
User Account	means the account created on the Platform by you;
VAT	means value added tax; and
You/ Your/ (similar reference)	refers to you as the user of the Platform.

 

By visiting the Platform, you confirm that you are at least eighteen (18) years of age, which is legal age to form a binding contract, and are not a person or entity barred from entering into contracts under the laws of the UAE or other applicable jurisdiction, and you provide unconditional consent to the Terms of Use. Please be aware that your current and future use of the Platform is subject to the Terms of Use. We urge you to read this document thoroughly. Should you disagree to be bound by the Terms of Use, please do not use the Platform in any way.

 

DESCRIPTION OF THE PLATFORM

This Platform is an online marketplace that sells inclusive and diverse women’s apparel and is aimed at making every woman find, feel, and flaunt the confidence she already holds. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.

 

SITE ACCESS

The Platform may be accessed on a mobile, tablet, laptop, computer, smart devices and other application program interfaces. Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable licence to:

1. access and use the Platform solely in connection with its indicated use; and
2. access and use any content, information and related materials that may be made available through the Platform, in each case solely for your personal use.

Any right which is not expressly granted in these Terms of Use, is reserved by us.

 

You are not permitted to copy, reproduce, duplicate, resell or transfer content of the Platform for any commercial purpose without prior written consent from the Platform. You hold responsibility to be fully aware of the laws that govern your relationship with the Platform.

 

REGISTRATION

You may access the Platform and purchase Products as a Registered User or a Guest. Registered Users shall have early access to preview future Product launches and have access to exclusive discounts. To become a Registered User, you are required to create a User Account and disclose basic personal information including your full name, email address and a private password. All registration requests are subject to our approval. You agree to provide accurate and complete information when registering for a User Account. You are prohibited to use a false email address or impersonate a person for the process of registration or at any other point of engagement with the Platform. We reserve the right, at any time and without advance notice, limitation, or liability, to terminate or suspend a User Account, and restrict your access to the Platform at our sole discretion.​​ In the event any information on your User Account is to be updated or amended, you can correct these errors by sending an email to info@forlovingyou.com  You may also correct such information or amend the shipping address at the time of checkout.

 

You are solely responsible for protecting the security and confidentiality of your User Account information and we shall not be liable for any theft or fraudulent use of your User Account. You shall immediately notify us of any unauthorised use of your User Account or identification or any breach of the Platform’s security. Our commitment to confidentiality is in accordance with our Privacy Policy.

 

The Platform shall not engage with any Registered User or Guest who has international sanctions (including but not limited to trade, military, economic) against them by an international, national, or regulatory authority. We shall not intentionally provide services to any of the United States Office of Foreign Assets Control (OFAC) sanctioned countries, subject to the laws of UAE. Kindly refrain from using the Platform if you are sanctioned by OFAC or deal with OFAC sanctioned persons or entities. In accessing the Platform, you will not seek to interrupt, interfere, or act in any manner whatsoever, contrary to the Terms of Use, or the applicable laws of the UAE.

 

ONLINE COMMUNICATION

The Platform engages with you, via emails, direct messages on Instagram and Facebook official accounts in the nature of receipts, advertisements, response to feedback, details relevant to your engagement on Facebook, Instagram, and LinkedIn. You consent to all electronic communication between us. The Platform also connects you to its social media accounts. Notwithstanding the above, the Platform has discretion to delete any comment, post or message uploaded by you on our social media account page, or delete any email exchanged between the Platform and you; any unlawful, harmful, threatening, abusive, defamatory, harassing, vulgar, profane, obscene, hateful, racially, ethnically or otherwise objectionable material of any kind, including but not limited to, any material which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, state, national or international law, uploaded by you.

 

By creating a User Account, you acknowledge we may send promotional or marketing emails from time to time, if you do not wish to receive such emails you may opt out at the ‘check out’ landing page or use the ‘unsubscribe link’ on such promotional/ marketing emails.

 

Discounts: Registered Users will be offered a one-time special discount of 15% at the time of registration, provided they subscribe to our marketing list on the Platform. Registered Users cannot use this offer in conjunction with any other offers, promotions or discounts and can only use it once.

 

We may introduce or discontinue discounts, offers or promotions on some or all Products from time to time, at our sole discretion, and these will be subject to terms and conditions specified against those discounts, offers and promotions.

 

THIRD-PARTY SITES

In your engagement with the Platform, you may come across links to Third-Party Sites such as Facebook, Instagram and/ or third-party advertisements, banners, or options, that shall not be governed by these Terms of Use. Once you click or access these Third-Party Sites, you will leave the Platform. We do not investigate, review, endorse, represent, or control the content of any Third-Party Sites, unless otherwise expressly stated in the Terms of Use. We urge you to carefully read the terms and conditions of all Third-Party Sites that you may be redirected to through the Platform or visit otherwise. We are not responsible or accountable for the content displayed on Third-Party Sites. You will access and use these Third-Party Sites at your sole risk and liability. You also agree not to link any other site or Third-Party Sites to the Platform without our express prior written consent and approval.

 

The Third-Party Sites may select and deliver (separate and unrelated to this Platform) advertising networks, advertising agencies, advertisers, and audience segment providers. These Third-parties Sites may collect information about you and your online activities, either on the Platform or on other websites, through cookies, web beacons, and other technologies, to understand your interests and deliver to you, advertisements that are tailored to your interests. We do not have access to, or control over, the information that Third-Party Sites may collect. The information practices of these third parties or Third-Party Sites are not covered in these Terms of Use or Privacy Policy. 

 

THIRD-PARTY TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control or input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the Platform is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Platform, including the release of new tools and resources. Such new features shall also be subject to these Terms of Use.

 

RESTRICTIONS

We reserve the right to restrict your access partially or fully to the Platform where any of the following occur:

1. we reasonably believe that you are, directly or indirectly, reselling, dealing or distributing any Product without our prior written consent;
2. we reasonably suspect fraud or illegal activity by you or your use of your User Account;
3. we have reason to suspect the security of your User Account has been compromised;
4. you solicit others to perform or participate in any unlawful acts;
5. you behave inappropriately, abusively, or offensively towards our staff, whether on call, email or in person, at any time;
6. you maintain a history of many cancelled orders, returns and refunds;
7. you maintain a history of attempting to return worn or damaged Products;
8. you violate any applicable international, federal, provincial or state regulations, rules, laws, or local ordinances;
9. you infringe upon or violate our intellectual property rights or the intellectual property rights of others;
10. you harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability anyone on the Platform;
11. you submit false or misleading information;
12. you to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Platform or of any related website, other websites, or the Internet;
13. you collect or track the personal information of others;
14. you to spam, phish, pharm, pretext, spider, crawl, or scrape;
15. you breach other terms set forth in these Terms of Use; or
16. you interfere with or circumvent the security features of the Platform, any related websites or the Internet.

 

PRODUCTS

A live inventory of Products will be displayed on the Platform for you to view and/or purchase from. We provide a product description for each Product, including but not limited to its price, size, colour, texture, material, special instructions (if any), delivery, cancellation and return policies. We reserve the right to amend the product description and prices from time to time at our sole discretion. Products may have different return policies subject to the type of Products.

 

You can either add a Product to ‘cart’ and continue shopping or choose to ‘buy it now’. To purchase a Product, you are required to disclose your shipping address, contact details and payment information (based on the payment option you choose). Specific delivery and return policy shall be provided to you prior to requesting for payment. We will email you an invoice and delivery details to the email address you provide to us at the time of check-out. You agree to provide current, complete and accurate information for all purchases. We will notify you in the event of any cancellation or a change in delivery details.

 

We reserve the right to limit the sales of our Products to any person, geographic region, or jurisdiction. We may exercise this right on a case-to-case basis. We reserve the right to limit the quantities of any Products from time to time and/or offer promotions or discounts on the Products or amend the description of any Product. Product pricing is subject to change at our sole discretion, at any time, without prior notice to you. We reserve the right to discontinue a Product at any time.

 

We take reasonable efforts to display on the Platform as accurately as possible, the colours and images of our Products however we cannot guarantee the colour accuracy displayed through your device. We may provide measurements or dimensions of a Product under its description on the Platform however these will only be approximate values, to give you a better understanding of the Product model or fit. We do not provide any guarantees for the actual measurements or colour of the Product you receive. The final measurements of a Product may vary depending on the material used in its production.

 

Our Products may contain small parts, including but not limited to extra buttons, tassels and zips which may be choking hazards for children below the age of 8 years old. Our Product packaging may include plastic wraps or bags that could be choking hazards to humans and animals. You are advised to use caution while handling and storing the Products and FLY shall not be liable for any claims in these respects. We are not responsible for any allergic reactions caused by the dyes used in fabrics.

 

We may issue coupon or discount codes from time to time, subject to specific terms and conditions, by FLY in its sole discretion and are subject to expiration and cancellation by FLY. Discounts offered shall not be redeemed for cash or returned via credit or debit card.  

 

We reserve the right to offer new Products/features through the Platform which shall also be subject to these Terms of Use.

 

PLATFORM PAYMENTS

All Product purchases shall be concluded on the Platform via Stripe, in the currency Arab Emirate Dirhams (AED) and in such case your credit or debit card will be charged at the time the purchase is made. You may also use PostPay to make payments in instalments. Payment methods such as Amex, Mastercard, Visa or Apple Pay may be used. The prices for Products shall be displayed on the Platform. An invoice shall be issued at ‘checkout’ and shall be inclusive of:

1. all applicable taxes;
2. applicable delivery and shipping charges;
3. applicable discounts or promotional offers; and
4. any bank charges if applicable.

 

It is your responsibility to check with your bank for any additional service charge, loyalty or convenience, finance, foreign exchange or other charges, prior to making a purchase on the Platform. The Platform shall not be held responsible or liable for any excess charges made by banks to your credit or debit card. Credit and debit cards are subject to authorisation and verification by respective card issuing entities. If the payment is not authorised by the respective entity, FLY shall not be liable for any delays or failure to deliver or to conclude any contract with you.

 

Your payment details shall be encrypted and our commitment to protect your financial information is in accordance with our Privacy Policy and we urge you to read it thoroughly before you proceed with your purchase. We DO NOT collect and do not intend to collect, any financial information, including CVV or credit card or debit card pins, from any purchases made by you on the Platform, although such information may be stored on a secure server on the Platform that is used only for your ease of convenient future purchases. Any data or personally identifiable information collected at the time of processing the transaction shall not be stored, sold, shared, rented or leased to third parties.

 

DELIVERY POLICY

Before you finalise your order, you shall be provided various delivery options to choose from, with estimated delivery time and dates depending on the delivery address. (We aim to deliver within two (2) Business Days following confirmation of an order.) If your order does not arrive by the scheduled date, please contact us at info@forlovingyou.com or at direct message on our Facebook or Instagram  official accounts. FLY reserves the right to amend its delivery policy (including Delivery Charges listed below) at any time.

 

Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 7 days, you may cancel your order. FLY may be delayed or prevented from carrying out its obligations hereunder due to a Force Majeure Event, and in such case, FLY shall notify you via email. In the event, such delay or prevention is carried out continuously for thirty (30) days, FLY shall notify you in writing and shall be excused from performance or liability for damages for any delay or non-performance, and any confirmed orders shall be cancelled by us.

(i)              Remote area Delivery Charges (applicable for next day delivery) within UAE shall be 15 AED in addition to the basic Delivery Charges;

(ii)             if the weight of your order is more than five (5) kilogram, an additional two (2) AED shall be charged for each kilogram and you understand and agree that additional charges may be payable by you in cash upon delivery in the event that Delivery Charges need to be adjusted due to weight fluctuations; and

(iii)           the above Delivery Charges are inclusive of all taxes in the UAE except for VAT.

(i)            The Delivery Charges are inclusive of all taxes except VAT, thirty eight point eight (38.8)% fuel surcharge and ten (10)% Emirates Post Fees. Fuel surcharge is subject to change on a monthly basis;

(ii)           the Delivery Charges are exclusive of custom duties (if applicable) to the country you are ordering from;

(iii)         any remote or out of area delivery shall be subject to extra charges; and

(iv)          the chargeable weight represents the greater of the gross weight or the volumetric weight.

 

Delivery Charges will be automatically calculated at ‘check out’.

 

CANCELLATION POLICY

You may cancel a confirmed order within one (1) hour of placing the order and we shall process a full refund provided that the cancellation request has been accepted by us, and the Product has not been dispatched for delivery to you.

 

RETURNS AND REFUND POLICY

You may submit a return request to us via email at info@forlovingyou.com, or direct message on our Facebook or Instagram  official accounts, within fourteen (14) days of the date of delivery and may request for a refund however you agree and acknowledge all refund requests are subject to our inspection of the Product(s). We do not provide refunds or exchanges on any swimwear and lingerie items.

All returns shall be free of charge but Delivery Charges shall not be refunded.. All returned Products must be in the same condition that you received them, unworn or unused, with tags, and in their original packaging, containing the original invoice of the purchase. If your refund request is approved by us, we shall provide you a full refund through the original mode of payment, within thirty (30) Business Days of approving your refund request. If your refund request is rejected by us, we will not be liable to process any refunds to you.

If you have received a defective Product, you are required to notify us via email or direct message, within twenty-four (24) hours of delivery and submit a return request. We shall inspect the Product and provide you a full refund if the Product is indeed defective. The provisions set forth herein do not limit any applicable statutory rights.

 

FEEDBACK AND COMPLAINTS POLICY

If, at any time, you have queries or concerns on any aspect of the Products, our conduct or any part of the relationship between yourself and FLY, please contact us at info@forlovingyou.com or direct message on our Facebook or Instagram  official accounts outlining the background and nature of your concern so that we might take the appropriate action to remedy the situation and resolve any outstanding issues.

 

If at our request, you send certain specific submissions (e.g. contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by postal mail, or otherwise comments, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We shall be under no obligation to:

1. maintain any comments in confidence;
2. pay compensation for any comments; or
3. respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material or contain any computer virus or other malware that could in any way affect the operation of a related website. You may not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. FLY takes no responsibility and assumes no liability for any comments posted by you or any third-party.

 

LIMITATION OF LIABILITY

You understand all aspects of all details provided on the Platform are not intended to be legal, financial, technical, medical, economical or professional advice of any kind, each of which are subject to further terms and conditions; thus, you are advised to read the specific terms or conditions of each, carefully. The Platform holds no liability to you for any direct, indirect, special, exemplary, incidental or consequential damages, including but not limited to, software glitches, inaccurate pricing due human or technical errors; damages for loss of profits, goodwill, use, data or other intangible losses, resulting from use of the Platform. Considering the above-mentioned exclusion of liability, in case any liability is established by an entity with jurisdiction in accordance with these Terms of Use, in a matter against us, you expressly acknowledge and agree that the maximum limit for any liability claim shall not in any event exceed the amount contributed by you to us in respect of the value of the specific product, to which any liability relates.

 

INTELLECTUAL PROPERTY

The entire content of the Platform, including but not limited to text, designs, know-how, techniques, brochures, templates, graphics, photographs, video, photographs, software, logos, text, arrangements and layouts are our sole and exclusive property, or are licensed to us and all rights are reserved and are protected by international copyright laws. All trademarks and trade names including and all other derivatives thereof including the trademarks appearing on the Platform are proprietary to us and may only be used by licensees authorised by us and are protected by international intellectual property rights laws. You agree not to use, disseminate, publish or reverse engineer any content or other intellectual property rights on this Platform without our prior written consent.

 

ASSIGNMENT

FLY may assign any rights or obligations under these Terms of Use with prior written notice to you, and in such case, the assignment shall be deemed automatic and with immediate effect, without the need for further notice or agreement. You may not assign any rights or obligations under these Terms of Use without prior written consent of FLY.

SURVIVABILITY

Termination of the contract between us in these Terms of Use does not affect either party’s accrued rights or liabilities prior to the date of termination.
