This Privacy Policy applies to the website of For Loving You FZE-LLC, that is https://forlovingyou.com/ and shall be read in conjunction with the Terms of Use.

FLY

means For Loving You FZE-LLC, an entity incorporated under the laws of UAE;

Personal Information

any data relating to an identified natural person, or one who can be identified directly or indirectly by way of linking data, using identifiers such as name, voice, picture, identification number, online identifier, geographic location, or one or more special features that express the physical, psychological, economic, cultural or social identity of such person;

 

Platform

means these terms, containing the policies and procedures on our collection, use and disclosure of Personal Information;

means the Products including but not limited to women’s apparel, sold on the Platform by FLY;

means third-party web pages that are linked on the Platform;

 

UAE

means United Arab Emirates;

refers to FLY domiciled in the UAE and its affiliates, subsidiaries and related entities;

means the account created on the Platform by you; and

 

You/ Your/ (similar reference)

SCOPE OF POLICY

 

Please be aware this Privacy Policy applies only to this Platform and the services we offer. Within the Platform, you may see links or references to Third-Party Sites, such as our Google, Facebook and Instagram pages , which are not covered by this Privacy Policy and are likely to have different information practices. We encourage you to read the privacy policy of all Third-Party Sites you visit or use. We provide any third-party references and links for your convenience only and to make your browsing experience better on the Platform and this should not be construed as an endorsement of Third-Party Sites in any manner. You are solely responsible for any interactions you may have with any Third-Party Sites.

USE OF THE PLATFORM

 

You should carefully read this Privacy Policy before using the Platform and, in particular, before providing any Personal Information through the Platform. Your full consent to this Privacy Policy and the Terms of Use is required in order to continue using this Platform. Please refrain from providing any Personal Information through this Platform and immediately stop using the Platform if the Privacy Policy is unacceptable to you.

 

COLLECTION OF INFORMATION

 

The Platform collects information in two (2) ways: actively and passively. We may collect information including Personal Information (your full name, email address, phone number) and non-Personal Information (e.g. aggregate statistics about what parts of our Platform are most popular).

 

Active information collection can include both Personal Information (e.g., your full name, address, mobile number, email address or similar information that is unique to you) and non-Personal Information (e.g., if we were to ask for a list of the top three things you like about our Platform).

 

Active information is collected from you in the following manner:

  1. a) Registration: A User may register on the Platform by creating an account using your existing email address. The registration form requires you to submit the following Personal Information:

(i)    your first name and last name;

(ii)   your email address; and

(iii)  to create a private password.

 

  1. b) Buy it now’: We shall collect Personal Information about you once you have selected the Products you wish to purchase, added them to your ‘cart’ and choose the ‘Buy it now' option. You shall be required to provide the following information:

(i)   your name and email address;

(ii)  your contact number;

(iii) your credit/debit card details;

(iv)  your shipping address;

(v)  your billing address; and

(vi) your geographical location (we shall seek your consent each time prior to identifying and recording your geographical location).

 

  1. c) Check out’: Once you click ‘Check out’, you confirm the debit or credit card used is yours. You also agree to provide current, complete and accurate information for all purchases, and to update information relating to your account including email, shipping address, phone numbers and debit/credit cards in order to complete transactions without any delays.
  2. d) Contact us: You may connect with us by sending us an email on info@forlovingyou.com or by sending a direct message on our official Facebook or Instagram accounts.

 

  1. e) Newsletter subscription: You may subscribe to our newsletter by submitting your email address on the Platform during ‘check out’.

 

  1. f) Payments: Users shall be required to submit their credit or debit card number and CVV to make payments on the Platform via Stripe payment gateway. Users can sign into their User Account or continue as a ‘guest’ to process payments on the Platform. You may be required to verify your card by your bank, which you consent to do, if requested. If you decline to verify your purchase or your identity, your payment may not be processed or accepted. You may also chose to make Payments on the Platform Using PostPay. If you choose to do so, you will be redirected to a Third-Party Site which will require you to submit your Personal Information. You fully understand and acknowledge that your payments routed via Stripe shall be subject to the terms and conditions and privacy policy of Stripe or PostPay, which we urge you to read and understand thoroughly prior to making any payments on the Platform. We DO NOT collect and do not intend to collect, any financial information. For clarity, information that you provide for billing purposes shall be stored solely by Stripe or PostPay including CVV or credit card pins, through any purchases made by you on the Platform. We do not access or use such financial information from the Platform in any manner.

 

  1. g) Retention: When you place an order through the Platform, we shall retain your Personal Information for our records unless and until you ask us to erase this information, where any deletion of records shall be subject to applicable UAE laws on retention of records.

 

Passive Information collection refers to instances in which we collect information from you that you have not actively provided. We may use special technologies to passively collect non-Personal Information from you. These technologies allow us to collect certain kinds of non-Personal Information, including but not limited to the type of web browser you use, Internet Protocol (IP) address, time zone, the date and time of your visit, the operating system you use, the specific pages you visit, the address of the website you visited prior to entering the Platform and the cookies that are installed on your device. Additionally, as you browse the Platform, we collect information about the individual web pages or Products that you view, what websites or search terms referred you to the Platform, and information about how you interact with the Platform. We do not link this passively collected information with Personal Information you have actively provided elsewhere on this Platform. We reserve the right to share with third parties, including our business partners and advertisers, the anonymous (non-personally identifiable) aggregated information that we have passively collected via this Platform.

If you are a resident of the European Economic Area, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. AUTOMATIC DECISION MAKING

If you are a resident of the European Economic Area, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data. Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  1. Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  2. Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

WHAT DO WE DO WITH THE INFORMATION WE COLLECT

 

The information we collect from you shall be used to:

  1. a) provide you with a better browsing experience on the Platform;
  2. b) help you conclude the purchase you make on the Platform;

If you receive marketing communication from us, you can email us and ask that we remove you from receiving marketing communications. We will cease all communication upon your request provided that such request is received at least (x)  days prior to the date of renewal of subscription. Please remember that if you opt out of receiving marketing communication only you may continue to receive administrative messages from us regarding your purchases or for the purposes of daily correspondence with us.

 

DATA SECURITY

 

We take reasonable steps to protect the Personal Information that you provide via this Platform, although no system is 100% secure or error-free and neither is the Platform. We do not, and cannot, guarantee the security or accuracy of the information we gather. It is your responsibility to keep your passwords secure. We strongly recommend that you do not share your passwords with any third-party nor store or save them in a manner that may be easily accessed by a third-party. We take the protection of your information very seriously and employ measures through administrative, technical, and physical safeguards designed to protect information against loss, theft, misuse, unauthorised access, disclosure, alteration, and destruction. We use best endeavours to encrypt all data in transit through appropriate security protocols provided to us by Shopify. We take reasonable precautions to ensure the integrity and security of our network and systems but cannot guarantee these security measures will prevent third parties from obtaining information by illegal actions or attacks.

  

DATA PROCESSING

 

Where you have consented to data processing, your consent provides the legal basis to process your Personal Information, such as when you consent to processing in relation to the processing of data for the purposes of data analysis in accordance with this Privacy Policy. You have the right to withdraw consent at any time. Please note that your withdrawal of consent to collect and process Personal information will not affect the lawfulness of processing Personal Information based on the consent before you withdraw your consent.

 

We may process your Personal Information on the basis of contractual necessity to perform a contract we have with you or complete a purchase you have made or are making or are reviewing on the Platform. We may also process your Personal Information on the basis of our legitimate interests, including analytic reporting and improving the functionality of the Platform. For example, we have a legitimate interest in collecting information about your device hardware and operating system to better understand how users access and use the Platform. Limits on use of your ‘Google user data’: Notwithstanding anything else in this Privacy Policy, consumer Google account information obtained via the Gmail Application Programming Interface’s (API), is subject to these additional restrictions:

  1. a) The Platform shall not use this Gmail data for serving advertisements.
  2. b) The Platform shall not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the Platform’s internal operations and even then, only when the data have been aggregated and de-identified.

 

 THIS PLATFORM IS NOT INTENDED FOR USE BY CHILDREN OR MINORS

 

This Platform is not directed to and does not seek to collect Personal Information from children under the age of eighteen (18) years. Nevertheless, if a minor accesses the Platform for any purpose whatsoever, or seeks services through the Platform, we reserve the right to ask for additional permissions and consents from the parent or guardian of the minor. For the purpose of this Platform, minor refers to any User under the age of eighteen (18) years. The aforementioned permissions and consents may change from time to time, on our discretion.

The platform aims to maintain public security through protection against internet-facilitated crimes including online fraud, threat, blackmail, and hacking. A division of the General Department of Criminal Investigation in Dubai, the Cybercrime Investigation Department consists of five specialised units: the Forgery and Credit Cards Unit, the Fraud and Scams Unit, the Identity and Defamation Unit, the Information Security Unit, as well as the Information and Development Unit.

Currency Conversion

 

By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your (the visitor) local currency.
